Terms of service
The terms and conditions of sale & service apply to all sales, deliveries, services and products supplied and sold by SafeTag Tracking or any of it’s affiliates, these affiliates will be any entity directed by DownRiver LIMITED (trading as SafeTag Tracking).
These general terms and conditions of sale & service may be overruled by product or service specific terms and conditions of sale & service, these will be made available and apparent to you if this is this case.
1. Commencement of service
SafeTag accepts confirmation of an order when written, including electronic, acceptance by a customers purchase order has been received by SafeTag and accepts the terms & conditions laid out by this document.
2. Delivery
The display of goods on the SafeTag Tracking site amounts to an invitation to treat only and is not an offer to sell products or services at any price indicated. No contract for the supply of products or goods will be deemed to exist between you and SafeTag Tracking unless, and until, an email is sent by SafeTag Tracking to you confirming that your order has been accepted and payment has been successfully made. This confirmation e-mail amounts to an acceptance by SafeTag Tracking of your offer to buy goods or services from SafeTag Tracking and this acceptance is effective regardless of whether or not you receive the e-mail. SafeTag Tracking is free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself. Price and availability information is subject to change without notice. SafeTag Tracking products are shipped EXW, whilst SafeTag Tracking may arrange and pay for the shipping of the product itself, the buyer is liable for all customs charges & duties in their respective country of delivery.
3. Payment
SafeTag Tracking reserves the right to cancel any service or any order that it desires for any reasonable reason with a full or pro-rata refund to the customer.
Business offers made by SafeTag Tracking have a duration of 30 days before they are automatically rescinded and are subject to the terms and conditions laid out in this document.
Unless otherwise arranged the full payment amount of an invoice is due at most 14 days after it is served.
SafeTag Tracking reserves the right to adjust accepted prices for non-delivered products in the event of changes in the rates of exchange, costs of materials, a sub-supplier's price increases, wages, or similar conditions over which SafeTag has no or limited control.
4. Alterations
SafeTag Tracking reserves the right to, without notice or approval from the customer to make alterations to a product that do not affect the agreed specifications or the products, form fit or function.
5. Service Provision
The service provided by SafeTag products is subject to receipt of payment before the commencement of the service. Without payment SafeTag reserves the right to cancel any ongoing service period either indefinitely or until payment is made for the period in which that payment was not received and for any future periods.
GPS Trackers sold by SafeTag with SafeTag branding are sold-as fixed units, the customer is not permitted to alter or edit SafeTag trackers in any way. In any violation of this policy SafeTag reserves the right to cancel its service effectively immediately, the customer takes full responsibility for their own health and safety and is not entitled to any refund.
6. Warranty Information
The warranty period of SafeTag Tracking branded trackers is subject to the warranty agreement accepted by the customer at the Point of Sale. This will be made evident to the customer either as one of the products USPs or via the product information section of the customers product on the website.
Any obvious alteration, physical damage or evidence of other misuse found will naturally nullify this guarantee and offer of replacement, and SafeTag Tracking is not liable for any damages caused by the altered unit or damages caused to the unit itself.
Any refund made to customers following the return of a tracker via warranty (for any reason) will not include any payment made for associated coverage subscription plans paid for either at the time of the tracker purchase or after that date. Subscription plan payments will not and cannot be refunded.
Any alteration of SafeTags trackers by the customer will result in the immediate cancellation of their warranty agreement, and SafeTag is not liable for any damages caused by the altered unit or damages caused to the unit itself.
7. Limitation of liability
Scope of Liability
Except as expressly stated in these Terms, SafeTag Tracking and its directors, employees, agents, or affiliates shall not be liable for:
- indirect, incidental, consequential, special, or punitive damages;
- loss of profits, revenue, goodwill, or data;
- damages arising from service interruptions, network failures, or improper use of products or services.
For claims arising directly from the use of SafeTag Tracking products or services, SafeTag’s aggregate liability shall not exceed the total amount paid by you for the specific product or service giving rise to the claim.
SafeTag does not exclude liability for any liability which cannot be lawfully excluded.
You acknowledge it is your responsibility to ensure network coverage, proper installation, and safe use of SafeTag devices. SafeTag makes reasonable efforts to provide accurate information and operational support, but cannot guarantee uninterrupted service globally.
8. Intellectual Property
Goods sold by SafeTag that are delivered with embedded software are of full ownership of DownRiver LIMITED. The customer obtains a non-exclusive licence to use this software subject to the specific purpose of the product. Aside, the customer obtains no rights or ownership of any licence, patent, copyright or trademark connected to the product. The customer does not own any right to the source code of embedded or non-embedded service software.
9. Resale
For international safety purposes, SafeTag reserves the right to be the only supplier of SafeTag branded goods and services, customers are not allowed to use or resell it’s products for purposes other than set-out by the device.
If the resale of devices is suspected, SafeTag reserves the rights to cancel any service provided for the device in question, and the customer who sold the device is liable for damages, either emotional or physical caused by this sale.
10. Governing law, Disputes and Jurisdiction
These Terms of Service, and any contract between you and SafeTag Tracking, are governed by and construed in accordance with the laws of England and Wales.
If a dispute arises out of or in connection with these Terms or the use of our products or services, the parties agree to try to resolve it amicably and in good faith within 30 days of one party giving written notice of the dispute to the other.
If the dispute cannot be resolved amicably, either party may refer the matter to binding arbitration in London, England, in accordance with the rules of the London Court of International Arbitration (LCIA), or another mutually agreed arbitration body.
The arbitration process will be conducted in English. The arbitrator’s decision will be final and binding, and the parties waive the right to appeal except where legally permitted.
Each party will bear its own costs, unless the arbitrator decides otherwise. To the fullest extent permitted by law, all disputes under these Terms must be resolved individually. You and SafeTag agree not to participate in any class action or representative proceedings.
11. Refunds, returns and cancellations
Any customer wishing to cancel an order under the rights provided by the Distance Selling Regulations/Sale of Goods Act must do so within 14 days of the point at which the goods were received. The goods must be returned by Signed Delivery (Insured) to our address. Customers are liable to pay the cost of this return postage. As long as the goods have been returned in an original unused condition the cost of the goods will be refunded to the customer’s credit/debit card within 14 days of the date of return. Any actual use of a GPS tracker (switching it on and obtaining tracking information) or other equipment by a customer is a breach of the customer’s duty to take reasonable care of the product and will negate their right to return under these regulations.
Recurring services purchased from SafeTag either en-masse (e.g. 12-month, 6-month, 3-month) or monthly are non-refundable either pro-rata or in full unless the provision of service is cancelled for any reason by SafeTag. SafeTag reserves this right with reason.
12. Coverage Plan Subscription Terms
By subscribing to our Coverage Plan services, customers agree to pay the recurring subscription fee as specified on our website or as communicated during the subscription process, which is billed in advance on a recurring basis, typically monthly or annually, depending on the subscription plan chosen.
Customers authorize SafeTag Tracking to automatically charge the designated payment method on file for the subscription fee at the beginning of each billing cycle.
SafeTag Tracking reserves the right to update subscription prices at any time for new customers. Existing customers will be notified in advance of any changes to the subscription fee or billing cycle, if this will affect existing subscriptions. The customers continued use of our services after such notification constitutes acceptance of the updated terms.
SafeTag Tracking also reserves the right to suspend or cancel tracker M2M Sim activation independently of the customers subscription status based automatic triggers related to misuse, abuse or non-use of the tracking devices they are installed inside.
We accept various payment methods, including but not limited to credit cards, debit cards, and other methods as specified on our website. The customer is responsible for ensuring that their payment information is current, accurate, and valid. Failure to do so may result in the suspension or termination of the customers subscription and tracker M2M Sim activation.
If customers are not based in the UK or EU, depending on the standard practise in the customers region, the subscription fee is exclusive of any applicable taxes, which will be added to the total amount due.
We reserve the right to terminate or suspend any subscription for non-payment or violation of our Terms of Service. Upon termination, any tracker associated with the terminated subscription will be immediately suspended, including live tracking, history recording, alerts etc.
Recurring coverage subscription services purchased from SafeTag Tracking either en-masse (e.g. 12-month, 6-month, 3-month) or monthly are non-refundable either pro-rata or in full under any circumstances, unless the provision of service is cancelled for any reason by SafeTag Tracking. SafeTag Tracking reserves this right with reason.

13. Illegal Acts
It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic ‘fingerprints’ of every order placed on this website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website. Products purchased from SafeTag Tracking may be governed by laws prohibiting their use; it is the sole responsibility of the purchaser/user to comply with these laws and no liability can be implied.
14. Tracking and Alert History
Tracking and Alert history and any other tracker data held on SafeTag Tracking servers will be maintained on the server only so long as the tracker is active/live/in use. Inactive trackers will be removed from SafeTag Tracking occasionally and entirely at the discretion of SafeTag Tracking. It is solely the responsibility of the tracker user (customer) to save their tracking history using the file export facility on the history page of their mapping panel. SafeTag Tracking has no liability under these terms for tracking history lost or deleted from SafeTag Tracking.
15. Service / Gsm Network Availability
SafeTag Tracking reserves the right to carry out regular maintenance of the SafeTag Tracking App, which may affect the availability of the Service. SafeTag Tracking will use its reasonable endeavors to ensure that apart from scheduled maintenance, the application is available for use at all other times.
16. Acceptable Use
The Service may not be used for any unlawful, fraudulent or abusive purpose and must be used as required by all applicable laws. The Customer indemnifies SafeTag Tracking in relation to any legal liability which may be incurred purely as a result of the Customer’s use of the Service. The Customer may allow third parties (including its employees and contractors) to access the online tracking service, but this will be at the Customer’s own risk. Access will be subject to the user agreeing to SafeTag Tracking’s terms of use from time to time as published on the website from which the online service is provided to the Customer.
17. Cancellation By Customer
SafeTag Tracking may terminate this agreement at any time, without notice, if the Customer breaches these Terms. No contract on these Terms may be terminated by the Customer, except in circumstances in which the Customer has lawfully terminated the contract (or part thereof) under which the device to which these Terms relate was supplied, in accordance with these terms. All other rights of termination which the Customer might otherwise have under the general law are expressly excluded.
18. Data Charges
The M2M SIM cards must not be removed from the tracking device this shall constitute misuse of the SIM and SafeTag Tracking shall be entitled to immediately terminate this agreement.
The customer agrees that SafeTag Tracking may monitor the use of the SIM to ensure compliance with the terms of this agreement. Equipment may be used in countries covered by the SIM card roaming agreements, subject to a prior agreement is necessary and should be arranged through SafeTag Tracking. SafeTag Tracking reserves the right to charge for over usage while roaming.
SafeTag Tracking suspends trackers of accounts that have not been accessed for 1 year. If you would like to continue using SafeTag Tracking system, the account must be accessed at least once in this time period.
19. Lost/Stolen SIMs
SafeTag Tracking should be informed immediately regarding any loss or stolen M2M SIM card if the Customer suspects or should reasonably suspect the M2M SIM card is being used in an unlawful or fraudulent manner. The Customer is responsible for all charges incurred up to the time of said notification. SafeTag Tracking requires evidence of alleged loss or theft in the form of a Police report. SafeTag Tracking will terminate or suspend service of the SafeTag Tracking if SafeTag Tracking suspects any wrongdoing.
20. Service Support
Service support is granted via the Help Center, and via Tickets (Email and Webform). We provide ticket service support to our users during our standard business hours. Our standard business hours and target response time are between 8AM-6PM Monday – Saturday UK and within 24 hours, although this is subject to change at the discretion of SafeTag Tracking. SafeTag Tracking does not accept liability for increased response times due to high ticket volume.
21. Customers Responsibilities & Agreement
You must follow all instructions for installation, use, and maintenance of SafeTag products and services. You are responsible for safe use, including the secure handling of devices and SIM cards.
You acknowledge that tracking data, alert history, and service performance may be affected by network availability, device misuse, or technical limitations. SafeTag will not be liable for loss of data or service interruptions except as required by law.
SafeTag’s liability in connection with software, apps, or service access is limited to the amount paid by you for the relevant service or product.
SafeTag shall not be liable for any consequential, incidental, or indirect damages, including loss of profits or business opportunities.
SafeTag does not exclude liability for any liability which cannot be lawfully excluded.
Customers agree not to bring claims directly against SafeTag employees, officers, or partners for acts carried out in connection with their work for SafeTag, except where prohibited by law.
All warranties which may otherwise be implied, including fitness for purpose or merchantability, are expressly excluded to the extent permitted by law, except as otherwise provided under consumer protection legislation. Magnetic trackers are supplied with strong industrial magnets which have been tested to support the tracking device if properly fitted. The customer is responsible for where and how the product is fitted. SafeTag Tracking is not liable if the device is lost or damaged.
22. Changes in Terms
SafeTag Tracking reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the SafeTag Tracking web site. The mapping site is updated and altered periodically without notice.
